1. Naturaleza del Servicio

Blaster Insight (en adelante, el "Servicio Insight") es un servicio innovador de investigación de mercados y consultoría estratégica de base tecnológica. Este servicio es el resultado de una alianza estratégica entre BLASTER DISEÑO S.A.S. y DGROUPE S.A.S., combinando experiencia en consultoría con tecnología avanzada.

2. Roles y Dinámica de la Prestación del Servicio

Para garantizar la máxima calidad en los resultados, nuestro servicio opera bajo el principio de "éxito compartido" y especialización técnica.

• Gestión Comercial y Estratégica: BLASTER es la entidad encargada de la cara comercial, la gestión de proyectos con los clientes, la aplicación de su metodología de investigación propia ("Metodología Blaster") y la curación estratégica de los informes. BLASTER es también la única responsable de suscribir los Acuerdos de Confidencialidad (NDA) con el cliente.
• Gestión Tecnológica: DGROUPE es el titular y responsable de la arquitectura de software, el código fuente y la infraestructura de inteligencia artificial (incluyendo agentes como "Agente Cero" y "Horizon Scanner") que procesan los datos de manera masiva y automatizada.

3. Fases de Ejecución del Proyecto

La prestación del Servicio Insight se divide en las siguientes etapas estandarizadas:

• Fase Comercial y Contractual: Evaluación de las necesidades del cliente, presentación de la propuesta comercial y firma del Acuerdo de Confidencialidad.
• Kick-off y Briefing Estratégico: Reunión de inicio para profundizar en el reto de negocio y carga de los parámetros en nuestra plataforma.
• Procesamiento y Ejecución Técnica: Recolección masiva de datos y generación de parámetros de investigación mediante nuestros agentes de Inteligencia Artificial.
• Curación y Análisis: Fase de intervención humana donde los estrategas filtran, interpretan y conectan los datos procesados por la IA para extraer insights de alto valor.
• Entrega y Cierre: Diseño del informe de investigación, presentación estratégica de los hallazgos y cierre administrativo.

4. Gestión de Cambios de Alcance

Cualquier solicitud por parte del cliente que exceda el alcance original definido en la propuesta comercial será sometida a evaluación. Si el cambio implica costos o tiempos adicionales debido a requerimientos técnicos o metodológicos, se preparará una orden de cambio que requerirá la aprobación expresa y por escrito del cliente antes de su implementación.

5. Propiedad Intelectual

• Propiedad Preexistente: BLASTER y DGROUPE conservan la titularidad única y exclusiva sobre sus metodologías, bases de datos históricas, software, herramientas de inteligencia artificial y cualquier propiedad intelectual previa a la prestación del servicio.
• Entregables Finales: Los hallazgos, recomendaciones y el documento que conforma el entregable final de la investigación serán de propiedad exclusiva del cliente únicamente una vez que se haya efectuado el pago total del servicio facturado.

6. Facturación y Pagos

BLASTER DISEÑO S.A.S. es la entidad legalmente responsable de emitir las facturas al cliente y de gestionar el recaudo de la totalidad de los ingresos generados por la prestación del Servicio Insight, salvo que se acuerde excepcionalmente lo contrario para proyectos específicos.

7. Ley Aplicable y Jurisdicción

La prestación del Servicio Insight y los acuerdos derivados del mismo se rigen e interpretan en su totalidad por las leyes de la República de Colombia. Cualquier controversia relacionada con la prestación del servicio será sometida a la jurisdicción de los tribunales competentes en la ciudad de Medellín, Colombia.

1. Nature of the Service

Blaster Insight (hereinafter, the "Insight Service") is an innovative market research and strategic consulting service based on technology. This service is the result of a strategic alliance between BLASTER DISEÑO S.A.S. and DGROUPE S.A.S., combining consulting experience with advanced technology.

2. Roles and Dynamics of Service Delivery

To ensure the highest quality in the results, our service operates under the principle of "shared success" and technical specialization.

• Commercial and Strategic Management: BLASTER is the entity in charge of the commercial face, project management with clients, the application of its own research methodology ("Blaster Methodology") and the strategic curation of reports. BLASTER is also solely responsible for signing Confidentiality Agreements (NDA) with the client.
• Technological Management: DGROUPE is the owner and responsible for the software architecture, source code and artificial intelligence infrastructure (including agents such as "Agent Zero" and "Horizon Scanner") that process data massively and automatically.

3. Phases of Project Execution

The provision of the Insight Service is divided into the following standardized stages:

• Commercial and Contractual Phase: Evaluation of client needs, presentation of the commercial proposal and signing of the Confidentiality Agreement.
• Kick-off and Strategic Briefing: Kick-off meeting to delve into the business challenge and load parameters into our platform.
• Processing and Technical Execution: Massive data collection and generation of research parameters using our Artificial Intelligence agents.
• Curation and Analysis: Phase of human intervention where strategists filter, interpret and connect the data processed by the AI to extract high-value insights.
• Delivery and Closing: Design of the research report, strategic presentation of the findings and administrative closing.

4. Scope Change Management

Any request from the client that exceeds the original scope defined in the commercial proposal will be subject to evaluation. If the change implies additional costs or times due to technical or methodological requirements, a change order will be prepared that will require the express and written approval of the client before its implementation.

5. Intellectual Property

• Pre-existing Property: BLASTER and DGROUPE retain sole and exclusive ownership of their methodologies, historical databases, software, artificial intelligence tools and any intellectual property prior to the provision of the service.
• Final Deliverables: The findings, recommendations and the document that makes up the final deliverable of the research will be the exclusive property of the client only once the total payment of the invoiced service has been made.

6. Billing and Payments

BLASTER DISEÑO S.A.S. is the legally responsible entity for issuing invoices to the client and for managing the collection of all income generated by the provision of the Insight Service, unless otherwise exceptionally agreed for specific projects.

7. Applicable Law and Jurisdiction

The provision of the Insight Service and the agreements derived from it are governed and interpreted in their entirety by the laws of the Republic of Colombia. Any controversy related to the provision of the service will be submitted to the jurisdiction of the competent courts in the city of Medellín, Colombia.
